The notary.

The notary in Spain plays a crucial role in managing the paperwork of the property, taxes and registering the with the Land Registry. They play a neutral role in the transaction, and make sure everything is done correctly according to the law. When you have accepted an offer, you will need to agree on a notary with the buyer.

 

Documentation

These are the documents you or your solicitor needs to make sure the sale goes smoothly:

  • The property's title deeds
  • Copies of utility bills
  • Receipts for local municipal tax (IBI) paid for the property
  • Your residency card (if applicable)
  • An inventory of furniture and other fixtures which will be included in the sale
  • Details of any relevant community statutes.

 

The deposit contract

Once the buyer's attorney has completed all the necessary due diligence checks, it's time to sign the deposit contract. This preliminary contract is drawn up by the buyer's attorney and both parties sign. A date will be provided for the completion of the purchase.

 

Deposit payment is made

At the same time as the preliminary contract is signed, the deposit is paid by the buyer. As in other parts of the world, the deposit is used as a clear sign of commitment to the transaction. Closing the transaction.

To complete the sale, a meeting will take place between the buyer, the seller and their respective legal representatives. The notary will also be present. This is where the purchase agreement (escritura de compravento)

The notary then informs the Land Registry of the sale and sends copies of the title deeds. The final balance will be transferred to you and the buyer will be given the keys to the property.
